1. Agreement to Terms

By accessing or using AR Recycle’s services (the “Service”), including our website (arrecycle.com), booking platform, or any related services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use our Services.

AR Recycle (“we,” “us,” “our”) provides secure e-waste recycling, hard disk data destruction, and IT asset disposition services to residents and businesses in Toronto and the Greater Toronto Area.


2. Description of Services

AR Recycle offers the following services:

  • Hard Disk Data Destruction: Physical shredding of hard drives and storage devices
  • Electronics Recycling Pickup: Collection and responsible recycling of e-waste
  • IT Asset Disposition (ITAD): Bulk e-waste solutions for businesses
  • On-Site Destruction Services: Mobile shredding at customer locations (by appointment)

All services are subject to availability and may be modified or discontinued at any time.


3. Eligibility

By using our Services, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal authority to enter into this agreement
  • You are the owner or authorized representative of the equipment being serviced
  • You have the right to authorize data destruction on the devices submitted

4. Booking & Scheduling

4.1 Appointment Booking

  • Services must be booked through our website, phone, or email
  • Appointment times are subject to availability and confirmation
  • We reserve the right to decline service requests at our discretion

4.2 Rescheduling & Cancellation

  • Free Cancellation: Cancel or reschedule up to 24 hours before your appointment at no charge
  • Late Cancellation: Cancellations within 24 hours may incur a $25 rescheduling fee
  • No-Show Policy: Failure to be present at the scheduled time without prior notice may result in a $50 no-show fee

4.3 Service Area

We currently serve Toronto and the Greater Toronto Area (GTA), including but not limited to: Downtown Toronto, Etobicoke, Scarborough, North York, York, Mississauga, Vaughan, Markham, Brampton, and Richmond Hill. Services outside this area may incur additional travel fees.


5. Pricing & Payment

5.1 Pricing

  • All prices are in Canadian Dollars (CAD)
  • Prices are subject to change without notice
  • Quoted prices are valid for 15 days from the date of quote
  • Additional fees may apply for:
    • Services outside standard business hours
    • Locations requiring special access or equipment
    • Hazardous materials or non-standard items
    • Travel outside our standard service area

5.2 Payment Terms

  • Payment is due at the time of service unless otherwise agreed in writing
  • We accept cash, credit cards (Visa, MasterCard), and e-transfer
  • For business accounts with pre-approved credit terms, payment is due within 30 days of invoice date
  • Late payments may incur interest at 2% per month

6. Customer Responsibilities

6.1 Item Preparation

You agree to:

  • Remove all personal batteries from devices before pickup (Toronto bylaw requirement)
  • Back up any data you wish to retain before submitting devices for destruction
  • Ensure items are accessible at the scheduled pickup location
  • Provide accurate address, buzzer codes, and access instructions
  • Be present at the scheduled time or arrange for authorized representative

6.2 Prohibited Items

We do NOT accept:

  • Large appliances (refrigerators, stoves, washers, dryers)
  • Air conditioners and dehumidifiers
  • Hazardous materials, chemicals, or paint
  • Light bulbs or fluorescent tubes
  • General household waste or Blue Bin recyclables
  • Items contaminated with biohazards or dangerous substances

7. Data Destruction & Liability

7.1 Data Destruction Process

  • We use physical destruction methods (shredding, crushing) to render data unrecoverable
  • Our destruction processes align with NIST 800-88 Rev. 1 guidelines
  • Certificates of Destruction are provided within 24-48 hours of service completion
  • We are PIPEDA-compliant in our handling of personal information

7.2 Limitation of Liability – Data

  • NO GUARANTEE: While we employ industry-standard destruction methods, we cannot guarantee that data destruction will be 100% effective in all cases due to factors beyond our control
  • CUSTOMER RESPONSIBILITY: You are solely responsible for backing up any data before submitting devices for destruction. AR Recycle is not responsible for data loss, recovery, or retrieval
  • LIABILITY CAP: Our total liability for any claim related to data destruction shall not exceed the amount you paid for the specific service giving rise to the claim
  • CONSEQUENTIAL DAMAGES: We are not liable for indirect, incidental, consequential, or punitive damages, including loss of business, data, or profits

7.3 Device Handling

  • We handle devices with reasonable care but are not responsible for pre-existing damage
  • We are not liable for cosmetic damage that occurs during normal handling and transportation
  • Maximum liability for lost or damaged devices is limited to $500 per device unless additional insurance is purchased

8. Data Storage & Communication

8.1 Information Collection

By submitting your information through our booking or contact forms, you agree that AR Recycle will collect and securely store your personal details, including but not limited to:

  • Full name
  • Phone number (including country code)
  • Email address
  • Physical address and pickup location
  • Service preferences and device information
  • Payment information (if any) (processed securely through third-party processors)

8.2 Purpose of Data Storage

We store your information for the following purposes:

  • Service Coordination: To confirm your booking, schedule pickups, and coordinate logistics
  • Communication: To contact you regarding your service appointment via phone, email, or text message
  • Documentation: To generate Certificates of Destruction and service records
  • Compliance: To meet legal, regulatory, and audit requirements under PIPEDA and Ontario’s Resource Recovery & Circular Economy Act
  • Customer Service: To respond to inquiries, resolve issues, and improve our services

8.3 Data Retention

  • We retain your personal information only as long as necessary to complete your service and fulfill operational, legal, or regulatory requirements
  • Service records and Certificates of Destruction are retained for a minimum of 7 years as required by law
  • After the retention period, your data is securely deleted or anonymized

8.4 Data Sharing

  • NO SALE: We do not sell, rent, or trade your personal information to third parties for marketing purposes
  • SERVICE PROVIDERS: We may share your information with trusted third-party service providers who assist us in operating our business (e.g., payment processors, recycling partners, IT services), provided they agree to maintain confidentiality and security
  • LEGAL REQUIREMENTS: We may disclose your information if required by law, court order, or government regulation

8.5 Your Consent

By providing your contact information, you expressly consent to:

  • AR Recycle storing your information as described above
  • AR Recycle using your information to contact you regarding your service via phone, email, SMS, or WhatsApp
  • Receiving service-related communications (appointment confirmations, reminders, Certificates of Destruction)
  • Receiving optional marketing communications (you may opt out at any time)

8.6 Data Security

We implement industry-standard security measures to protect your information, including encryption, secure servers, and access controls. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

8.7 Your Rights

Under PIPEDA, you have the right to:

  • Access your personal information held by us
  • Request correction of inaccurate information
  • Withdraw consent for data processing (subject to legal requirements)
  • Request deletion of your data (subject to retention requirements)

9. Environmental Compliance

  • All collected e-waste is processed in accordance with Ontario’s Resource Recovery & Circular Economy Act
  • We partner with EPRA-approved recycling facilities
  • We maintain a zero-landfill policy for all collected materials
  • Hazardous components are handled and disposed of according to environmental regulations

10. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of AR Recycle or its content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.


11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AR RECYCLE’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

IN NO EVENT SHALL AR RECYCLE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.


13. Indemnification

You agree to indemnify, defend, and hold harmless AR Recycle, its owners, employees, and agents from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your submission of devices you do not own or have authority to dispose of

14. Privacy Policy

Your privacy is important to us. Our Privacy Policy, available at arrecycle.com/privacy, explains how we collect, use, and protect your personal information. By using our Services, you agree to the collection and use of information in accordance with our Privacy Policy.


15. Third-Party Links

Our website may contain links to third-party websites or services that are not owned or controlled by AR Recycle. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. You access such links at your own risk.


16. Changes to Terms

We reserve the right to modify or update these Terms at any time at our sole discretion. When we do, we will:

  • Post the updated Terms on our website
  • Update the “Last Updated” date
  • For material changes, notify you via email or website notice

Your continued use of our Services after any such change constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue use of our Services.


17. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any disputes arising from these Terms or our Services shall be resolved exclusively in the courts located in Toronto, Ontario, Canada.


18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.


19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AR Recycle regarding the Services and supersede all prior or contemporaneous understandings or agreements, whether written or oral.

21. Acceptance

By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use our Services.
